ESIC Extends New Amnesty Scheme 2025 to December 31

ESIC says employers and insured people now have until December 31, 2026 to use its New Amnesty Scheme 2025, following the original September deadline. India Today and News On AIR reported the extension. The scheme, which had been scheduled to conclude on September 30, 2026, will now remain accessible until December 31, 2026, on existing terms and conditions.
Authorities introduced the three-month extension following formal requests submitted by various commercial stakeholders seeking additional time to complete dispute resolution procedures. The measure aims to lower pending court caseloads and encourage enterprise establishments to comply with statutory regulations under the erstwhile Employees' State Insurance Act.
Scope of Dispute Resolution and Judicial Relief
According to the Union Labour Ministry, court proceedings instituted up to March 31, 2025, are eligible for settlement under the provisions of the amnesty initiative. This dispute resolution initiative establishes a formal pathway for commercial establishments to settle outstanding legal conflicts with the insurance corporation out of court without protracted litigation.
On July 24, 2025, the Employees' State Insurance Corporation issued circular no. P-11/14/Amnesty Scheme/2023-Rev.II announcing the launch of the New Amnesty Scheme, 2025, according to AscentHR.
The framework specifically allows for the settlement of ad-hoc contribution assessments when employers remit actual assessed contributions alongside applicable interest charges, without requiring payment of statutory damages. For cases where employers have already remitted their principal contribution dues, the scheme permits full withdrawal of pending court cases upon submitting 10 percent of the disputed damages amount.
Litigation instituted by the corporation concerning delayed remittances or the non-submission of statutory records, which were subsequently rectified by the establishment, can also be withdrawn with judicial permission. The relief applies only where applicants satisfy the scheme’s specified payment and procedural conditions; it does not erase every liability or guarantee a dispute will be settled.
The Central Government brought the Code on Social Security, 2020 into effect on November 21, 2025. The amnesty announcement nevertheless addresses disputes arising under the earlier ESI Act; case eligibility depends on the scheme’s rules.
Administrative Objectives and Business Impact
The initiative directly supports national policy goals aimed at enhancing the ease of doing business while upholding the statutory rights of insured citizens served by the social security system.
The extended window grants eligible employers and insured beneficiaries additional time to complete documentation and avail themselves of the relief measures. Through this extension, the government seeks to foster long-term compliance, ease administrative burdens on labour tribunals, and restore regular contribution cycles across registered industrial units.
