New York City Tightens Regulations on E-Bike Use

New York City has implemented strict new operating limits for electric bicycles, capping speeds at 15 mph on all city streets to enhance public safety. These measures follow an increase in high-profile traffic accidents involving micromobility vehicles. The city currently enforces requirements under Local Law 39 of 2023, which mandates that all e-bikes sold within city limits carry UL 2849 system and UL 2271 battery certifications. While state law categorizes e-bikes into three distinct classes with higher speed allowances, the city’s municipal regulations take precedence over these state-level speed caps.

The current focus on safety stems from growing concerns regarding delivery rider behavior and vehicle compliance. The New York City Council is actively reviewing a package of 17 proposed bills designed to overhaul micromobility management. These proposals aim to increase accountability for major delivery platforms, mandate commercial licensing for delivery workers, and require additional insurance policies. Authorities indicate these efforts are a direct response to the integration of e-bikes into urban life, which has outpaced current traffic enforcement mechanisms.

The proposed legislative package may result in a total ban on the sale of certain Class 3 e-bike models currently legal in other jurisdictions. This potential policy shift highlights the tension between promoting greener urban transportation and managing the inherent risks of high-speed micromobility on crowded thoroughfares. Residents and delivery operators should anticipate stricter enforcement of speed caps and increased scrutiny of retail compliance with battery safety standards.
