Kerala SHRC: Unaided School Staff Entitled to Service Benefits

The Kerala State Human Rights Commission (SHRC) has mandated that employees in unaided schools are entitled to essential service benefits, including subsistence allowance, gratuity, and provident fund (PF). Led by Chairperson Justice Alexander Thomas, the commission ruled that school management cannot legally withhold these entitlements. The decision stems from a lack of clear state-issued orders defining wage and service conditions for the unaided education sector, leading to widespread confusion regarding employee rights.

The ruling followed a complaint from a teacher at Kamukincode Higher Secondary School in Thiruvananthapuram. The complainant, who was suspended in 2023 and subsequently dismissed in 2024, faced a denial of all terminal and suspension-period benefits. The commission has now directed the complainant to engage the district labor officer to secure gratuity payments, while the PF commissioner is tasked with recovering dues from the school management should the teacher's eligibility be confirmed.

This order serves as a major precedent for staff in private, unaided educational institutions across the state. By explicitly stating that these institutions are bound to provide standard service benefits, the SHRC has filled a regulatory gap that previously allowed for the exploitation of staff. The commission's focus on the legal obligation of employers ensures that private education staff maintain a safety net equivalent to their counterparts in government-aided sectors. Moving forward, this ruling is expected to force management bodies to standardize human resource practices in alignment with existing labor laws.
