Karnataka High Court Reprimands Bengaluru Police Over Illegal Arrests

The High Court of Karnataka has strongly reprimanded the Bengaluru police for repeated procedural violations, remarking that the Whitefield police station should be renamed "Darkfield." Justice M. Nagaprasanna quashed legal proceedings against the petitioner, Mohan Gowda, and imposed a cost of three lakh rupees on the Whitefield police officers involved in an illegal arrest case. Law enforcement officers completely ignored established arrest guidelines and violated constitutional safeguards regarding individual liberty by executing the arrest without serving mandatory legal notices.

The verdict follows a petition filed by Mohan Gowda, a representative of the Hindu Rashtra Samanvaya Samithi, who was illegally detained after sharing a social media post expressing opposition to a live performance by comedian Kunal Kamra. Highlighting deep-seated institutional lawlessness, the court noted that senior supervisory officers, including the Deputy Commissioner of Police for Whitefield, failed to prevent these procedural abuses. The court ordered that the fine be paid directly to the petitioner and authorized the state government to recover the full penalty amount from the salaries of the guilty officers, setting a firm precedent for police accountability.

This judicial intervention centers on the consistent failure of law enforcement to adhere to mandatory arrest guidelines designed to protect civil liberties. Legal observers noted that the court was particularly concerned about the misuse of police power to silence individuals expressing dissenting views on public events. The court directed the Director General and Inspector General of Police to issue warnings and fresh compliance guidelines across the force, serving as a benchmark for how future law enforcement actions will be reviewed by the judiciary.
