Jens Spahn Resigns: German CDU Leader Quits Over Surrogacy Controversy

Senior German politician Jens Spahn has resigned as the parliamentary group leader of the Christian Democratic Union (CDU) following a public outcry over his use of a surrogate mother. Spahn and his husband, Daniel Funke, recently welcomed their son, Georg, born via a surrogate in the United States. This personal development sparked immediate accusations of hypocrisy because surrogacy remains strictly prohibited in Germany under the 1990 Embryo Protection Act. Spahn previously supported this ban during his tenure as health minister in 2020. He stated that his personal happiness as a father had become incompatible with his high-ranking political office.

The CDU recently reaffirmed its commitment to the domestic surrogacy ban during a party conference in February 2026. Critics from multiple political parties argued that Spahn’s actions undermined his credibility and the official stance of the conservative opposition. While raising a child born to a surrogate abroad is legal in Germany, the act of surrogacy itself carries a penalty of up to three years in prison within the country. Spahn acknowledged that the balancing act between his private family decisions and the expectations of his leadership role became greater than he had anticipated. Chancellor candidate Friedrich Merz described the resignation as both right and inevitable.

Spahn’s departure removes a prominent, often polarizing figure from the CDU leadership during a critical period of regional elections. Alexander Hoffmann of the Christian Social Union (CSU) will temporarily assume Spahn's duties until a formal successor is appointed.
