Delhi High Court Rules AI Training On News Content Is Fair Dealing

The Delhi High Court has issued a landmark ruling on July 26, 2026, determining that the use of published news content for training Large Language Models (LLMs) qualifies as fair dealing under Section 52(1)(a) of the Indian Copyright Act. This decision effectively denied an interim injunction plea filed by ANI, establishing a significant legal framework for AI developers operating within the Asian market. The court further clarified that text generated by AI models like ChatGPT does not constitute a substantial reproduction of copyrighted material.

This judicial development coincides with broader efforts by the Ministry of Electronics and Information Technology (MeitY) to govern synthetic media. Since February 2026, new IT rules have been in effect, introducing a formal legal definition for synthetically generated information. These regulations impose strict compliance timelines, requiring intermediaries to remove flagged content within three hours for lawful orders and two hours for specific complaints, reflecting a tightening regulatory environment for digital platforms.

The ruling provides much-needed clarity for AI companies, though it sets a high bar for media organizations seeking to protect their intellectual property. Meanwhile, the Uttar Pradesh government is scaling its infrastructure to support this AI-driven future, planning the PRAGATI hub in Noida. This 75-acre facility aims to integrate robotics and advanced manufacturing, projecting a contribution of over Rs 20 billion in gross value addition and the creation of 100,000 jobs over the next five years.
