Allahabad HC Orders Swift Enrolment For Newly Qualified Advocates

The Allahabad High Court has issued a significant directive to the Bar Council of Uttar Pradesh, ordering the issuance of permanent enrolment numbers to advocates within four weeks of them clearing the All India Bar Examination. This ruling addresses the prolonged delays faced by newly qualified lawyers in obtaining the necessary credentials to practice law officially. The court emphasized that administrative delays must not hinder the career progression of law graduates who have met all statutory requirements. This decision provides much-needed relief to thousands of aspiring legal professionals across the state.

In addition to the timing of enrolment, the High Court clarified the rules surrounding the timeline for clearing the mandatory bar exam. Law graduates from the 2009-10 academic year onwards are required to clear the AIBE within two years of their provisional enrolment to continue their legal practice. The clarification was secured following a plea by Advocate Kartikkumar S. of Law Seva Associates, who sought to resolve ambiguities regarding the practice rights of newly enrolled members. This legal benchmark ensures that the transition from provisional to permanent practice is governed by clear, time-bound parameters.

This judicial intervention is expected to streamline the functioning of the UP Bar Council and eliminate the backlog of pending enrolment applications.
