Tamil Nadu Challenges High Court Reservation Ruling

The Tamil Nadu government has filed a Special Leave Petition in the Supreme Court to challenge a recent Madras High Court judgment. The High Court had ruled as unconstitutional a 2024 government order (GO) that permitted individuals converting to Islam from Backward Classes, Scheduled Castes, or other identified communities to retain their backward class reservation status under the 'BC (Muslim)' category. The state argues that the policy is necessary to ensure that individuals do not lose their social benefits upon conversion.

The Madras High Court bench, comprising Justice GR Swaminathan and Justice PB Balaji, held that a convert to Islam should be treated strictly as a Muslim, and granting community certificates for specific backward sects upon conversion contradicted existing judicial precedents. The court case originated from a plea by an individual whose application for a 'Muslim Lebbai' community certificate was rejected by local authorities following his 2015 conversion.

The State of Tamil Nadu maintains that the policy was designed after comprehensive deliberation by the State Backwards Classes Commission. By providing reservation benefits to those who convert, the government aims to maintain social equity and prevent the loss of opportunities for vulnerable groups. The Supreme Court's upcoming decision will determine the constitutionality of this inclusion-based approach, which remains a cornerstone of the state's social welfare framework.
