Supreme Court Proposes Strict Regulatory Framework for AI Integration in Indian Courts

The Supreme Court of India’s Artificial Intelligence Committee has unveiled its draft Regulations for Use of Artificial Intelligence in Courts, 2026. This framework establishes a comprehensive governance structure for applying AI tools across the nation’s judicial system, including district tribunals and subordinate courts. The proposal emphasizes five foundational pillars: human primacy, transparency, accountability, data protection, and judicial independence.

The draft explicitly mandates that AI systems must function solely in an assistive capacity, remaining strictly subservient to human judicial authority. Prohibited applications include determining final case outcomes, assessing witness credibility, or monitoring judicial officers and litigants without explicit legal authorization. Furthermore, the regulations require legal practitioners to formally disclose any use of AI tools when filing pleadings, evidence, or other court documents.

To ensure compliance, the Supreme Court proposes the creation of an apex body tasked with developing national standards and approving specific AI technologies for court use. This initiative seeks to modernize the legal process while mitigating risks associated with algorithmic bias or unauthorized data usage.
